Self-Serve Terms of Use

These Self-Serve Terms of Use ("Terms") govern access to and use of the Jsonify platform, products, APIs, and related services (collectively, the "Services"), operated by Trailing Comma, Inc., a Delaware corporation doing business as Jsonify ("Jsonify", "we", "us", or "our").

You accept these Terms by checking the box presented when you create an account, enable billing or authorize the Services through a third-party assistant integration. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

1. Order of Precedence

If you have a signed agreement with Jsonify, that agreement governs your use of the Services, and the parties' roles — including data-protection roles — are as set out in it. These Terms apply to self-serve use of the Services where no signed agreement exists.

2. Description of the Services

Jsonify builds and operates data pipelines: programs that read websites and mobile apps you confirm, extract data into your schema, check every row, and deliver datasets to the destinations you choose. Jason, Jsonify's AI data engineer, proposes sources, designs schemas, builds pipelines, and repairs them when a source changes.

Jason is an AI system; messages and emails from Jason are generated by AI. Jason proposes; you decide. No pipeline runs against a source until you have confirmed that source, and you are responsible for the sources, schemas, and schedules you confirm.

3. Business Use Only

The Services are offered solely for business and professional use. They are not offered to, and may not be used by, consumers acting for personal, family, or household purposes. You represent that you are using the Services for business purposes.

4. Your Responsibilities

You are responsible for:

• Confirming the websites, apps, and documents your pipelines read;
• Determining whether you are legally authorized to access, extract, and use data from the sources you confirm, supply and select;
• Ensuring that your use of the Services and of the datasets complies with applicable laws and regulations, including data protection, intellectual property, competition, and contractual obligations;
• Assessing whether the terms of the sources you confirm bind you, and complying with them where they do;
• For restricted sources, supplying or confirming the specific URLs to be read and holding any permission the source requires;
• For Provider-sourced Data, having a lawful basis for your use of any personal data it contains.

Jsonify does not provide legal advice and does not assess the legality of your specific use cases.

5. Source Access

Technical Access controls. The Services do not access content behind login walls, paywalls, or other gated access, with one exception: an account you connect yourself, on a source where Jsonify permits it, under Section 6. The Services do not provide functionality for you to defeat authentication or payment requirements.

Site-owner signals. For websites, robots.txt is read when a source is added to a pipeline. Jsonify honours rules addressed to its collector by name (JsonifyBot) and builds no collection for paths those rules disallow. Website and app owners can ask us to stop at any time (see For website and app owners). You can ask for stricter robots.txt handling for your pipelines, documented in writing.

Source classification. Jsonify classifies sources. Most are open. Some are restricted: collection is limited to URLs you supply or confirm, at volumes Jsonify sets, and Jason does not propose them. Some are provider-routed: Jsonify's own pipelines do not collect from them, and Jsonify may obtain data from them through a specialist fetch provider acting as its subprocessor (see Provider-sourced Data below). Some are blocked and cannot be used on self-serve plans. Jsonify decides the classification and may change it at any time; a change is handled as source removal under Section 12. Classification also decides whether an account can be connected to a source: for many sources and categories of source it cannot.

Provider-sourced Data. For provider-routed sources, Jsonify obtains data through a third-party fetch provider that collects the requested pages on Jsonify's instruction, as Jsonify's subprocessor ("Provider-sourced Data"). Jsonify's source rules in this Section — technical access controls, site-owner signals and load — apply to requests made through a provider in the same way as to Jsonify's own pipelines. Jsonify selects providers with reasonable care, reviews their documented collection practices before using them, and may request documentation from them to confirm compliance. If Jsonify becomes aware that a provider has collected in breach of those rules, Jsonify will stop using the affected data and inform you without undue delay. Provider-sourced Data is obtained for your request, is not cached across customers, and is not included in datasets Jsonify offers to others. It may include professional information that individuals have made public, such as name, job title and employer. Jsonify does not supply personal email addresses or phone numbers from Provider-sourced Data. Jsonify may withdraw a provider, or stop supplying data from a provider-routed source, at any time; Section 12 applies.

Fetch, search and enrichment providers that perform steps within a Jsonify pipeline are subprocessors, not data vendors; the commitments in this Section apply to those steps.

Load. Pipelines are designed to read sources politely, at rates intended not to disrupt the source's normal operation.

6. Authenticated Access

6.1 Only some sources. Connecting an account is not available for sources generally. Jsonify blocks it for many sources and categories of source, and may block any source at any time. It is not permitted for: social networks and messaging services; sources whose gated content consists mainly of profiles of or information about individuals; email, banking, payment, health, and government accounts; any source whose operator has objected; and any other source Jsonify blocks.

6.2 You sign in; Jsonify does not. You connect an account by signing in yourself, in a browser session the Services provide, or by importing session cookies from your own browser. Jsonify does not store or log your password, create accounts, accept a source's terms on your behalf, or bypass multi-factor authentication. Jsonify stores the resulting session, encrypted, and pipelines use it until it expires or you disconnect it; they then stop until you reconnect.

6.3 Your account, your authorization. You represent that the account is yours or your organization's; that it was not purchased, borrowed, or created to obtain access you would not otherwise have; and that the source's terms, or your agreement with its operator, permit you to use automation with it. Pipelines read only what the account is entitled to see. Permitting a source is not a determination by Jsonify that your use of it is authorized.

6.4 Separation. Content collected through a connected account is collected for you alone. It is not cached across customers, not reused for other customers, and not included in Jsonify's independent collection or in datasets Jsonify offers to others.

6.5 Withdrawal. Jsonify may block a source for connected accounts, or end a session, at any time, including on an objection from the source's operator or where a source restricts accounts used with the Services. Section 12 applies. Jsonify does not control how a source's operator treats your account.

7. Source Terms

Some sources publish terms relating to automated access or data extraction. You are responsible for assessing whether and how such terms bind you and apply to your use of the Services. Jsonify may provide informational tools that identify potential restrictions, but does not guarantee their completeness or accuracy. Some sources permit automated access only under licence or through an official API. Where you name such a source, obtaining that permission is your responsibility.

8. Personal Data

Where a pipeline processes personal data on your behalf, you act as the data controller and Jsonify acts as your data processor under the Data Processing Addendum, which is incorporated into these Terms. You are responsible for having a valid legal basis for the processing you configure, for respecting data-subject rights, and for not collecting special categories of personal data unless strictly lawful.

Jsonify does not reuse, sell, or otherwise exploit data processed on your behalf for its own purposes, except as described in Section 10 (de-identified operational metrics).

9. Acceptable Use

Your use of the Services is subject to the Acceptable Use Policy, which forms part of these Terms.

10. Customer Data, Platform Ownership, and Operational Metrics

Customer Data and Delivered Dataset. As between you and Jsonify, you retain ownership of your schemas and your source lists. In these Terms, "Customer Data" means your schemas and your source lists. Ownership of your schemas covers your specific definitions as you provided them, not the underlying use case, data type or field set.

"Delivered Dataset" means the dataset Jsonify compiles and delivers to you, including its selection, arrangement, structure, normalisation and enrichment. It is distinct from the individual data items it contains ("Underlying Data").

Subject to payment of the fees due for the rows it contains, Jsonify grants you a non-exclusive, worldwide, irrevocable, transferable and non-sublicensable licence over the Delivered Dataset. No fee is due for the licence beyond the fees set out in Section 11. The licence covers all rights Jsonify holds in the Delivered Dataset, including copyright in its selection and arrangement and the sui generis right of the database producer. You may use the Delivered Dataset for any lawful purpose in accordance with our Acceptable Use Policy, including commercial purposes. In particular, you may reproduce, extract, re-use, display, adapt, modify, translate, aggregate and combine it with other data, create derivative works from it, and use it to train, test or evaluate any model. You may also distribute, make available, sell, rent and otherwise commercialise it, in whole or in part, on any medium and by any means. The licence is granted for the full duration of the rights concerned, including any extension or renewal. It survives the termination or expiry of these Terms. This licence does not permit distribution or resale of Provider-sourced Data, content from restricted sources, or content collected through a connected account, except as part of a product or service in which it is not separately extractable. The licence over rows obtained in breach of the Acceptable Use Policy ends with the breach.

The licence does not cover the Underlying Data. Jsonify does not own the Underlying Data and does not transfer or license any right in it. The Underlying Data remains subject to the rights of its original source owners and to the rights of individuals whose personal data it contains.

What belongs to Jsonify. Jsonify owns its platform and all pipeline code, including extractors, regardless of source: public websites, mobile apps, and sources accessed through an account you connect or credentials you supply. Jsonify also owns the technical domain knowledge accumulated while building, operating and repairing pipelines, including knowledge of page structures and extraction methods. Jsonify may reuse platform components, including extractors for public sources, across customers; commissioning collection from a source does not give you exclusive rights to its extractor. Extractors built to run on an account you connect or credentials you supply are not reused for other customers. Jsonify grants you a non-exclusive, non-transferable and non-sublicensable licence to access and use our Services and the extractors run for you, solely to the extent necessary to receive the Services under these Terms. The licence is granted worldwide for the duration of the Services. It ends automatically when the Services end, for any reason. You may allow your employees and contractors to use the platform on your behalf. You remain responsible for their use, including our Acceptable Use Policy. The licence does not include any right to access, copy, modify, decompile or reverse engineer the platform or the extractors.

No exclusivity over use cases. You receive no exclusivity over use cases, data types or field sets. Jsonify may build pipelines and publish templates for other customers that collect similar data, whether or not they resemble yours.

Independent collection. Jsonify may independently collect the same or similar public data, from the same sources, for itself or for other customers, including in datasets it offers to others. That independent collection is not Customer Data or a Delivered Dataset of yours. Content from restricted sources, collected through a connected account, and Provider-sourced Data are not cached across customers and are not included in datasets Jsonify offers to others.

The boundary. Reusable platform components exclude your schemas, source lists, Delivered Datasets, credentials, personal data, and confidential business information. Jsonify does not use Delivered Datasets to train models, and does not copy them into datasets offered to others; any dataset Jsonify offers to others comes from its own collection.

Operational metrics. Jsonify may generate and use de-identified, aggregated operational metrics about the Services — such as source counts, repair times, and reliability statistics — that do not reveal Customer Data or Delivered Datasets or identify you, including in published statistics.

No source access. Self-serve plans do not include access to pipeline source code. You may not reverse engineer, decompile, or attempt to extract the source code of the Services or of pipelines, except to the extent applicable law permits it notwithstanding this limitation.

Feedback. "Feedback" means any suggestion, idea, comment, enhancement request or other input you give Jsonify about the platform or the Services. Feedback does not include Customer Data or your confidential information.

You have no obligation to provide Feedback. If you do, you provide it "as is", without any warranty of any kind. Jsonify has no obligation to use it.

You assign to Jsonify all rights you hold in each item of Feedback, as and when you provide it. The assignment covers the rights to reproduce, display, adapt, modify, translate, incorporate into any product or service, distribute and commercialise the Feedback, in whole or in part, on any medium and by any means. It is granted worldwide, for any purpose and for the full duration of the rights concerned, including any extension or renewal. The assignment is made free of charge. Jsonify is not required to attribute Feedback to you.

Providing Feedback gives Jsonify no right in your name, trademarks, Customer Data or confidential information.

11. Billing

Rows. The Services are metered by row. A row is counted only when it has passed its checks and reached your dataset, or when Jason hands you collected records in a chat. The pricing page, including its published rates and row definitions, is incorporated into these Terms.

Billing in arrears. Usage is billed at the end of each calendar month for rows actually collected in that month, to your payment method on file.

Failed payments. If a charge fails, we may retry it and will notify you. If payment remains outstanding after notice, we may pause pipelines and suspend access until the balance is settled.

Taxes. Fees are exclusive of taxes. You are responsible for applicable sales tax, VAT, GST, and similar taxes.

Price changes. We may change published prices with at least 30 days' notice by email, and may also notify you in the product. Changes apply from the next billing month after the notice period; they never apply retroactively.

Cost of collection. In rare cases a source costs far more to collect than the published per-row rate assumes, for example because of very large pages or frequent repairs. Where the cost of serving a pipeline or an account is grossly disproportionate to the rows it produces, Jsonify may throttle or pause the affected pipelines, or offer you different terms for them: a source-specific per-row rate, a fixed monthly plan in place of per-row billing, or an enterprise agreement. We will notify you by email and identify the affected pipelines. Different terms apply only to rows collected after you accept them, and are otherwise subject to the price-change notice above. If you do not accept, the affected pipelines stay paused and you are not billed for rows not collected. Throttling or pausing a pipeline under this section is not a breach of these Terms.

Refunds and disputes. Fees are non-refundable except where required by law or expressly stated otherwise, or where a charge results from our billing error. Raise billing disputes within 30 days of the charge.

12. Source Removal

Jsonify may stop collection from any source at any time — including in response to an objection from the source's operator, a legal demand, or a change in legal or operational risk — and may delete collected data where we are required to. Where reasonably practicable, we will notify you and identify the affected pipelines. Your remedy is that you are not billed for rows not collected; source removal is not a breach of these Terms.

13. Term, Suspension, and Termination

Your right to terminate. You may stop using the Services and close your account at any time, in particular in case of a change in prices pursuant to Section 11.

Suspension. Jsonify may suspend or terminate access if required by law or a competent authority, to prevent material legal, security, or operational risk, for non-payment after notice, if you materially breach these Terms, or as Section 11 (Cost of collection) allows. We will give you at least 15 days' written notice before suspending the Services for a breach of these Terms. The notice will describe the breach. If you cure the breach within that period, we will not suspend the Services.

We may suspend the Services immediately, without prior notice, if your use of the Services creates a risk to the security or integrity of the platform, our systems or third-party systems, is unlawful, or exposes Jsonify to liability towards a third party. In that case, we will notify you of the suspension and its reason as soon as possible.

Free-tier inactivity. Pipelines on the free tier may be paused after a period of inactivity, and their data deleted after at least 30 days’ notice by email.

Export and deletion. After your account closes, you have 30 days to export your Delivered Datasets, after which we may delete them and your Customer Data, subject to legal retention obligations and limited backup cycles.

14. Confidentiality

"Confidential Information" means any non-public information one party (the "Discloser") discloses to the other (the "Recipient") in connection with these Terms, in any form, that is marked as confidential or that a reasonable person would understand to be confidential. It does not include information that (a) is or becomes public through no fault of the Recipient, (b) the Recipient already knew free of any confidentiality obligation, (c) the Recipient lawfully receives from a third party free of any confidentiality obligation, or (d) the Recipient develops independently without using the Discloser's information.

The Recipient will protect Confidential Information with at least the care it uses for its own confidential information, and never less than reasonable care. It will use it only to perform or receive the Services. It will disclose it only to its employees, officers, contractors and professional advisers who need it for that purpose and are bound by obligations at least as protective as this clause. The Recipient is responsible for their compliance.

If law or a competent authority requires disclosure, the Recipient will, where legally permitted, notify the Discloser promptly and disclose only what is required.

On request or when these Terms end, the Recipient will return or destroy the Confidential Information.

These obligations apply during these Terms and for five years after they end.

15. Publicity

Jsonify will not use your name or logo in customer lists or marketing without your prior consent.

16. Third-Party Services and Beta Features

The Services interoperate with third-party destinations and assistants you connect (for example a spreadsheet, warehouse, or AI assistant). Those services are governed by their own terms, and Jsonify is not responsible for them. Features identified as beta or preview are provided as-is, may change or be withdrawn, and may be excluded from support commitments.

17. Warranties and Disclaimers

The Services are provided "as is" and "as available". Jsonify disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the above, Jsonify does not warrant that datasets are accurate, complete, or current; fields derived by machine-learning models may be wrong; and automatic repair of pipelines is not guaranteed to succeed or to occur within any particular time. Jsonify does not warrant that use of the Services will be lawful in all jurisdictions or for all use cases.

18. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, consequential, or punitive damages. Neither party is liable for any loss of profits, revenue, business, goodwill or anticipated savings, for any loss or corruption of data, for business interruption, or for the cost of procuring substitute services. This applies whether the claim is based on contract, tort (including negligence), strict liability or any other legal theory, and even if the party was advised that such damages were possible. Jsonify is not liable for claims arising from your access to or use of third-party sources or data, or from your compliance with laws or third-party terms.

Jsonify's total liability under these Terms shall not exceed the greater of (a) the amounts you paid to Jsonify in the twelve months preceding the claim and (b) US$100.

19. Indemnification

You will defend and indemnify Jsonify against third-party claims, and resulting damages, losses, and reasonable expenses, to the extent arising from: (a) the sources you confirm; (b) your use of the Delivered Datasets; (c) accounts you connect or credentials you supply; or (d) your breach of the Acceptable Use Policy.

Jsonify will promptly notify you of any such claim, allow you to control the defence and settlement (provided any settlement releases Jsonify and imposes no obligation on it), and reasonably cooperate at your expense. Jsonify may participate with its own counsel at its own cost.

20. Changes to These Terms

Jsonify may update these Terms from time to time. For material changes, we will give at least 30 days' notice before the change takes effect, by email to your account address or by a prominent notice in the product. Non-material changes take effect when posted on this page with a revised "Last updated" date.

21. General

Governing law. These Terms are governed by the laws of the State of Delaware, excluding its conflict of law principles. Disputes are subject to the exclusive jurisdiction of the state or federal courts located in Delaware, USA.

Assignment. You may not assign these Terms without Jsonify's consent; Jsonify may assign them in connection with a merger, acquisition, or sale of assets.

Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.

Export and sanctions. You may not use the Services in violation of export-control or sanctions laws, and you represent that you are not on any restricted-party list.

Severability; waiver. If a provision is unenforceable, the remainder stays in effect. A failure to enforce a provision is not a waiver of it.

Entire agreement. These Terms, the documents they incorporate, and any signed agreement under Section 1 are the entire agreement between the parties about the Services.

Notices. Notices to you may be sent to your account email address or shown as a prominent notice in the product, except where these Terms require email. Notices to Jsonify go to the contact below.
