Self-Serve Terms of Use

These Self-Serve Terms of Use ("Terms") govern access to and use of the Jsonify platform, products, APIs, and related services (collectively, the "Services"), operated by Trailing Comma, Inc., a Delaware corporation doing business as Jsonify ("Jsonify", "we", "us", or "our").
You accept these Terms when you create an account, when you enable billing, or when you authorize the Services through a third-party assistant integration. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
1. Order of Precedence
If you have a signed agreement with Jsonify, that agreement governs your use of the Services, and the parties' roles — including data-protection roles — are as set out in it. These Terms apply to self-serve use of the Services where no signed agreement exists, and to the extent a signed agreement does not address a topic.
2. Description of the Services
Jsonify builds and operates data pipelines: programs that read websites and mobile apps you confirm, extract data into your schema, check every row, and deliver datasets to the destinations you choose. Jason, Jsonify's AI data engineer, proposes sources, designs schemas, builds pipelines, and repairs them when a source changes.
Jason is an AI system; messages and emails from Jason are generated by AI. Jason proposes; you decide. No pipeline runs against a source until you have confirmed that source, and you are responsible for the sources, schemas, and schedules you confirm.
3. Business Use Only
The Services are offered solely for business and professional use. They are not offered to, and may not be used by, consumers acting for personal, family, or household purposes. You represent that you are using the Services for business purposes.
4. Your Responsibilities
You are responsible for:
- Confirming the websites, apps, and documents your pipelines read;
- Determining whether you are legally authorized to access, extract, and use data from the sources you confirm;
- Ensuring that your use of the Services and of the datasets complies with applicable laws and regulations, including data protection, intellectual property, competition, and contractual obligations;
- Assessing whether the terms of the sources you confirm bind you, and complying with them where they do.
Jsonify does not provide legal advice and does not assess the legality of your specific use cases.
5. Source Access
Access controls. The Services do not access content behind login walls, paywalls, or other gated access, except where an enterprise agreement provides for authenticated access using credentials the customer legitimately holds (see Section 6). The Services do not provide functionality for you to defeat authentication or payment requirements.
Robots.txt. For websites, robots.txt is read when a source is added to a pipeline, and no collection is built for paths it disallows at that time.
Load. Pipelines are designed to read sources politely, at rates intended not to disrupt the source's normal operation.
Method. Jsonify chooses the technical method of collection, including the networks, browsers, and fetch providers requests are sent through.
6. Authenticated Access
Access to content that requires authentication is available only under an enterprise agreement, which governs how credentials are supplied, stored, and used. Self-serve pipelines do not accept customer credentials. Where an enterprise agreement provides for authenticated access, the customer represents that it legitimately holds the credentials, is authorized to use automation with the account, and stays within the permissions the relevant provider has granted it.
7. Source Terms
Some sources publish terms relating to automated access or data extraction. You are responsible for assessing whether and how such terms bind you and apply to your use of the Services. Jsonify may provide informational tools that identify potential restrictions, but does not guarantee their completeness or accuracy.
8. Personal Data
Where a pipeline processes personal data on your behalf, you act as the data controller and Jsonify acts as your data processor under the Data Processing Addendum, which is incorporated into these Terms. You are responsible for having a valid legal basis for the processing you configure, for respecting data-subject rights, and for not collecting special categories of personal data unless strictly lawful.
Jsonify does not reuse, sell, or otherwise exploit data processed on your behalf for its own purposes, except as described in Section 10 (de-identified operational metrics).
9. Acceptable Use
Your use of the Services is subject to the Acceptable Use Policy, which forms part of these Terms.
10. Customer Data, Platform Ownership, and Operational Metrics
What is yours. As between you and Jsonify, you retain ownership of your schemas, your source lists, and the rows delivered to you ("Customer Data"). Ownership of your schemas covers your specific definitions as you provided them, not the underlying use case, data type or field set. This does not transfer rights belonging to third-party source owners or limit the rights of individuals whose personal data is processed.
What belongs to Jsonify. Jsonify owns its platform and all pipeline code, including extractors, regardless of source: public websites, mobile apps, and sources accessed with credentials you supply under an enterprise agreement. Jsonify also owns the technical domain knowledge accumulated while building, operating and repairing pipelines, including knowledge of page structures and extraction methods. Jsonify may reuse platform components, including extractors for public sources, across customers; commissioning collection from a source does not give you exclusive rights to its extractor. Extractors built to run on credentials you supply are not reused for other customers. An enterprise agreement may grant a non-exclusive, perpetual, royalty-free licence to use and modify a snapshot of your pipelines, as deployed when the agreement ends, for your own internal purposes; that licence does not transfer ownership, and does not permit resale, redistribution, or offering the code as a service to others.
No exclusivity over use cases. You receive no exclusivity over use cases, data types or field sets. Jsonify may build pipelines and publish templates for other customers that collect similar data, whether or not they resemble yours.
Independent collection. Customer Data is the copy of rows delivered to you. Jsonify may independently collect the same or similar public data, from the same sources, for itself or for other customers, including in datasets it offers to others. That independent collection is not Customer Data.
The boundary. Reusable platform components exclude your schemas, source lists, Customer Data, credentials, personal data, and confidential business information. Jsonify does not use Customer Data to train models, and does not copy Customer Data into datasets offered to others; any dataset Jsonify offers to others comes from its own collection.
Operational metrics. Jsonify may generate and use de-identified, aggregated operational metrics about the Services — such as source counts, repair times, and reliability statistics — that do not reveal Customer Data or identify you, including in published statistics.
No source access. Self-serve plans do not include access to pipeline source code. You may not reverse engineer, decompile, or attempt to extract the source code of the Services or of pipelines, except to the extent applicable law permits it notwithstanding this limitation.
11. Billing
Rows. The Services are metered by row. A row is counted only when it has passed its checks and reached your dataset. The pricing page, including its published rates and row definitions, is incorporated into these Terms.
Free tier and minimum. Each month, up to 100 rows are free; unused free rows do not carry over. Above the free allowance, monthly usage is billed at the greater of US$49 and rows collected multiplied by the per-row rate for that volume, as published on the pricing page. Billing only begins after you explicitly enable it and provide a payment method; the Services do not charge you without that step.
Billing in arrears. Usage is billed at the end of each calendar month for rows actually collected in that month, to your payment method on file.
Failed payments. If a charge fails, we may retry it and will notify you. If payment remains outstanding after notice, we may pause pipelines and suspend access until the balance is settled.
Taxes. Fees are exclusive of taxes. You are responsible for applicable sales tax, VAT, GST, and similar charges, other than taxes on Jsonify's income.
Price changes. We may change published prices with at least 30 days' notice by email. Changes apply from the next billing month after the notice period; they never apply retroactively.
Refunds and disputes. Fees are non-refundable except where required by law or expressly stated otherwise, or where a charge results from our billing error. Raise billing disputes within 30 days of the charge.
12. Source Removal
Jsonify may stop collection from any source at any time — including in response to an objection from the source's operator, a legal demand, or a change in legal or operational risk — and may delete collected data where we are required to. Where reasonably practicable, we will notify you and identify the affected pipelines. Your remedy is that you are not billed for rows not collected; source removal is not a breach of these Terms.
13. Term, Suspension, and Termination
Your right to terminate. You may stop using the Services and close your account at any time.
Suspension. Jsonify may suspend or terminate access if required by law or a competent authority, to prevent material legal, security, or operational risk, for non-payment after notice, or if you materially breach these Terms. Where reasonably practicable, we will provide notice before suspension.
Free-tier inactivity. Pipelines on the free tier may be paused after a period of inactivity, and their data deleted after at least 30 days’ notice by email.
Export and deletion. After your account closes, you have 30 days to export your datasets, after which we may delete Customer Data, subject to legal retention obligations and limited backup cycles.
14. Confidentiality
Each party will protect the other's non-public information with at least the care it uses for its own confidential information, use it only in connection with the Services, and not disclose it except to those who need it and are bound by comparable obligations, or where disclosure is required by law.
15. Feedback and Publicity
If you provide feedback about the Services, Jsonify may use it without restriction or obligation. Jsonify will not use your name or logo in customer lists or marketing without your prior consent.
16. Third-Party Services and Beta Features
The Services interoperate with third-party destinations and assistants you connect (for example a spreadsheet, warehouse, or AI assistant). Those services are governed by their own terms, and Jsonify is not responsible for them. Features identified as beta or preview are provided as-is, may change or be withdrawn, and may be excluded from support commitments.
17. Warranties and Disclaimers
The Services are provided "as is" and "as available". Jsonify disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the above, Jsonify does not warrant that datasets are accurate, complete, or current; fields derived by machine-learning models may be wrong; and automatic repair of pipelines is not guaranteed to succeed or to occur within any particular time. Jsonify does not warrant that use of the Services will be lawful in all jurisdictions or for all use cases.
18. Limitation of Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, consequential, or punitive damages. Jsonify is not liable for claims arising from your access to or use of third-party sources or data, or from your compliance with laws or third-party terms.
Jsonify's total liability under these Terms shall not exceed the greater of (a) the amounts you paid to Jsonify in the twelve months preceding the claim and (b) US$100.
19. Indemnification
You will defend and indemnify Jsonify against third-party claims, and resulting damages, losses, and reasonable expenses, to the extent arising from: (a) the sources you confirm; (b) your use of the datasets; (c) credentials you supply under an enterprise agreement; or (d) your breach of the Acceptable Use Policy.
Jsonify will promptly notify you of any such claim, allow you to control the defence and settlement (provided any settlement releases Jsonify and imposes no obligation on it), and reasonably cooperate at your expense. Jsonify may participate with its own counsel at its own cost.
20. Changes to These Terms
Jsonify may update these Terms from time to time. For material changes, we will give at least 30 days' notice by email to your account address before the change takes effect. Non-material changes take effect when posted on this page with a revised "Last updated" date.
21. General
Governing law. These Terms are governed by the laws of the State of Delaware, excluding its conflict of law principles. Disputes are subject to the exclusive jurisdiction of the state or federal courts located in Delaware, USA.
Assignment. You may not assign these Terms without Jsonify's consent; Jsonify may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
Export and sanctions. You may not use the Services in violation of export-control or sanctions laws, and you represent that you are not on any restricted-party list.
Severability; waiver. If a provision is unenforceable, the remainder stays in effect. A failure to enforce a provision is not a waiver of it.
Entire agreement. These Terms, the documents they incorporate, and any signed agreement under Section 1 are the entire agreement between the parties about the Services.
